MINI SESSION AGREEMENT

This document is a contractual agreement made between: Kalai Lynam (referred to hereafter as “Photographer”) and Client.

AGREEMENT TERMS

HEALTH: If you or your child has or had a fever within 24 hours of our shoot, please call or email to reschedule at no extra fee. The health of our family and keeping our clients safe from illness is of the upmost importance. If you arrive and anyone in your party shows signs of being sick (coughing, sneezing, runny nose..etc), you will be asked to kindly leave so that no other children are exposed. Thank you for understanding.

PORTRAIT SESSION: Client will have up to 20 minutes of shoot time. Mini sessions are limited time wise, so groups of 3 or more may require additional sessions which will be disclosed at the time of booking.

SAFETY: Client agrees to hold child/children on lap at all times while waiting for their shoot to begin. They will not let their child/children roam around. The photographer is not liable for any harm or accidents the client's child may incur.

CANCELLATION/POSTPONEMENT: Client understands that by entering into this agreement, Photographer is foregoing other photographic jobs. In the event of a cancellation or postponement of the portrait session/agreement by Client, the amounts paid are non-refundable. Deposits are transferable if a date change is necessary. Forty-eight hours notice of postponements or cancellations is appreciated.

WEATHER: If it is not possible for a session to take place on a scheduled day due to weather, Photographer and Client will reschedule on an agreed date at the earliest date possible, with no additional charge.

COOPERATION/NO SHOWS: Photographer is not responsible if Client and/or key individuals fail to appear or cooperate during portrait sessions. If the photo session must be rescheduled due to clients cooperation where the photographer has traveled to reach the destination, additional travel fees will apply. Because mini sessions are scheduled on a very tight basis, any amount of time the client is late will be deducted from their session. Client agrees to try to arrive 10 minutes before their time slot to prevent this. The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. The photographer will not be held accountable for not photographing desired people if there is no one to assist in identifying people or gathering people for the photographs. Kalai Photography is not responsible if key individuals fail to appear or cooperate during photography session. Reshoots due to lack of cooperation of any of the photographed individuals will be scheduled at the photographers regular hourly rate.

CLIENT’S USAGE: Client is obtaining prints for personal use only, and shall not sell said prints or authorize any reproductions by parties other than Photographer. Prints for publication (such as editorial, public relations or advertising use) require prior written consent from Photographer. A credit line which reads “Kalai Photography” in type no smaller than that of the related text must appear adjacent to or within all permitted published photographs.

No images shall be further edited in any way without photographer’s permission, this includes but is not limited to applying filters when posting images on Facebook, Instagram etc.

By using any of these images, you are agreeing to the above terms.

EXHIBITION: Client grants Photographer permission to display selected images resulting from this assignment as an example of Photographer’s work and for entrance into photographic competitions and releases all claims to profits that may arise from use of images.

LIMIT OF LIABILITY: We take the utmost care with respect to the exposure, retouching, and transportation of digital captures, proofs and prints. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond Photographer’s control, Photographer’s liability is limited to the refund of all payments received, or a re-shoot can be scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a prorated amount of the total amount, based on the percentage of originals lost or damaged. In the unlikely event that Photographer is injured or becomes too ill to attend the portrait session, Photographer will make every effort to reschedule to the earliest possible date.

MINI SESSION FEES: Mini Portrait Sessions fees are $170 for up to 3 children sitting up age and over. There is a fee of $10 per extra child over 3 children. This fee covers the 20 minute session, photographer’s time, creative process, and 5 digital images, and a print release. A deposit of $50 is due at the time of booking. A downloadable link containing 5 images in hi-resolution from the session delivered via email after photographer has edited the images. Session fees are determined in advance based on the number of individuals to be photographed and the location of the photo shoot and will always be announced at the time of the mini session release. The balance of the session fee is due on the day of Client’s portrait session, and is payable before shooting begins. Clients must bring the session fee, payable by either check or cash, to the session. Please no exceptions.

Tardiness: In the event that the client is late to the appointment time, the client’s session will still be for the same scheduled ending time. Mini sessions are scheduled back to back so running over into another client's scheduled time is not allowed.

COPYRIGHT AND REPRODUCTION The client agrees that all copyrights and/or intellectual property rights for all photographs taken at the session shall be held exclusively by KALAI Photography. The client will receive images via online gallery, and may print at their discretion as well as purchase professional prints and items from the photographer. The client may also post images online and to social media (i.e. Facebook, Instagram, etc.) but must note KALAI Photography as the photographer and include a tag where feasible. The client is encouraged to back up their images upon receiving them. Your purchase of the original files releases KALAI Photography from any liability due to loss or damage of the images, and also releases KALAI Photography from any obligation to maintain copies of any digital file, image, or photograph. The client may not sell, distribute or take credit for any of the photos taken by KALAI Photography. KALAI Photography highly recommends that photographs be printed only through a professional printing lab.  If client prefers to print through a low quality printer, KALAI Photography is not responsible for client being displeased with those printed products.

MODEL RELEASE:  The undersigned hereby grants KALAI Photography the absolute and irrevocable right and permission, in respect to the photographs, video tapes, motion pictures, recordings, or any other media (hereinafter collectively known as “Images”) that KALAI Photography has taken of me or my property, or minors in my care, or in which I may be included with others, to copyright the same, in KALAI Photography’s own name or otherwise, to use, re-use, publish, re-publish, post, display, in printed form, or in any and all media now or hereafter known, and for any legitimate purpose whatsoever. You hereby grant to KALAI Photography the right to use and publish images and photographs taken at your photography session to further promote its service, including portfolio, print, web site, display, advertisement, and editorial use. KALAI Photography agrees to limit the use of these images and photographs to promotional use only. KALAI Photography may revoke this license at any time and for any reason. KALAI Photography retains all copyrights to the images and derivative works thereof. KALAI Photography agrees to only use first names of baby, and will leave any Social Media "tagging" up to the parents unless requested.

RETOUCHING, CONVERSIONS AND DIGITAL FILES: Standard retouching includes light blemish and stray hair removal. Complex retouching includes such changes as the removal of scars or heavy blemishes. Tonal conversions include converting color images to black-and-white. Files are automatically lightly retouched for no added fee. Complex retouching may result in an additional fee.

WAIVER OF LIABILITY RELEASE By agreeing to a photography session with KALAI Photography, I am hereby waiving, releasing, and discharging KALAI and all its affiliates, from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me or my family including my traveling to and from this event. KALAI Photography is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.  Client swears that each person is participating voluntarily in the said photography session and forfeit all right to bring a suit against Kalai Lynam or KALAI Photography for any reason. KALAI is not responsible for uncooperative parties.  It is understood that the behavior of children is unpredictable, however, photographer is not liable if children do not cooperate during sessions.

ENTIRE AGREEMENT: This agreement contains the entire understanding between Photographer and Client. It supersedes all prior agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement, it does not mean that any other provision is also waived.

This constitutes an order for one portrait mini session with KALAI Photography.

Session Requests

*No cameras are allowed during the session. Please respect the artist and do not stand behind them with your cell phone to take the same photo. The photographer will not continue if there are other cameras or video taping during the session (not including cake smash sessions).

*Session starts at the agreed upon time. It is strongly encouraged that client arrives 5-10 minutes prior to the start of session. This allows for any last-minute feeding, changing, fixing hair/makeup prior to start of session.

*Please do not bring any children not being photographed to the session. Or extra "helpers" who are usually more of a distraction than help.

*Please make sure hair is combed and face is clean and free of runny noses or eyes.

*Please avoid eating or drinking red or orange food or drinks before session, as red and orange tend to leave a stain on the face.
